THE “VILAPPIL SALA” ISSUE


At the lok adalath on the vilappilSala issue I kept my mouth tightly shut in the face of the torrent from the opposite party's lawyer.
Ultimately the member of the adalath had to caution the opposite party that she is not supposed to use unparliamentary language in the adalath ( even when it is directed to jyothi ? Really ! )
The other member of the lok adalath, a lady, was looking at me quzzically – I just returned the smile. And finding an obliging audience in the madam, the opposite party opened up and within no time the cat was out of the bag; and I got a decision completely in my favour.
The lok adalath is a give and take affair. But thanks to the outburst from the other side I did not have to give in any thing at all.
When the opposite party asked for two months time to comply with the decision that was granted. On second thoughts they changed their mind and asked for three months time and there again, I agreed.
If you think you can get rid of me otherwise in three months' time you are welcome; I am game.
It is just a question of enforcing law;
but no,
some people do not have any legal rights!

ILLEGAL HAZARDOUS BUILDING : REQUEST DEMOLITION


Sir,
I. I am the resident of the house KP. No.V/168 of the karakulam panchayath. KP. No.V/168 as well as the 3.37 are plot in survey no. 43/2-1-3 on which it stands is fully owned by me.

II. This is to bring to your kind notice the existence of what I presume an unauthorised building being used as a plant for making rubber sheets on a commercial basis in the plot adjacent to my residence (sketch enclosed as Appendix A).

III. The above building is in complete violation of the provisions and conditions of the Kerala Panchayath Building Rules (KPBR) 2011 and is a severe health hazard to those living in the vicinity ( as elaborate in Appendix B).

IV. I feel that, in the interests of the public, the above structure ought to be demolished.

V. My complaints on the matter to Mr.Zain-ud-din, known to be the owner of the plant, has fallen on deaf ears.

VI. In view of the above it is hereby requested of you to kindly look into the matter and do the needful at the earliest.

APPENDIX B

A. The structure referred to in my letter No.jyo/cT/01 dt May 06, 2013 as far as my information goes is an unauthorized construction and is being used for rubber sheet making on a commercial basis.

B. The above building should come under Group I (2) hazardous category ( vide rule No.34. (2) and rule No.34. (3) (l) of KPBR 2011 ).
Group I (2) buildings are supposed to have a minimum open yard of 10 ( ten ) meters on all sides. ( vide rule No.61 (3) of KPBR 2011 ). 

However, the above building has an open yard of just 75 Centimeters on the side adjacent to the eastern side of my plot of land ( sketch enclosed as appendix A )

C. The effluent from the plant is being splayed all over the place. The atmospheric air is being polluted by the foul smelling gases and the noxious chemicals released poses a severe health hazard to any one living in the vicinity.

Whatever is mentioned above is true to the best of my knowledge and belief.

the colouration of the water could just be a co-incidence as well.
but i am not aware of any other change that has taken place in the atmosphere in the interim between 16 and 28 may except for the fact that the rubber sheet making has been stopped.
